Overview

Determining how sales and use tax apply to software and the cloud can be intimidating for even experienced tax professionals, and with good reason. Sales of software, cloud computing services, software-related services, and digital goods can be taxed differently on a state-by-state basis.

Even the way in which software is delivered (tangible vs. electronically vs. remotely accessed) and whether it’s prewritten or custom can mean the difference between the sale being taxable or exempt.

There is a lot of potential for making mistakes when determining how sales and use tax apply to software and the cloud. And that can lead to costly errors and increased audit risk. Attend this webinar to make sure you’re handling sales and use tax correctly on these transactions.

Who should attend? This webinar is intended for financial and operations personnel—including tax, general accounting, accounts payable, sales, tax technology, purchasing and credit—who deal with sales and use tax as part of their responsibilities. The course is also intended for those who make sales or purchases of cloud or software products. The course is also designed for general practitioners, with minimal to no experience.

Additional Details About the Webinar

States across the country have been enacting legislative changes that determine how they characterize sales of software, cloud computing and digital goods for sales tax purposes. Are you aware of the changes taking place across the states? If not, you may be subjecting yourself to significant audit risk.

In addition to the different states’ rules regarding taxation of software and the cloud, software maintenance agreements bring further complications. The method of delivery and the manner in which the maintenance agreement is sold often has an impact on the sale’s taxability. Understanding how software-related services is another crucial piece of the puzzle.

For sellers of software and related services, the webinar will cover the importance of distinguishing the different services you are providing so you aren’t creating a tax obligation unnecessarily.

We’ll also cover practical issues such as contract and invoice language, documentation of delivery method, and sourcing rules.
