As we pass the second anniversary of the historic U.S. Supreme Court decision in South Dakota v. Wayfair, the initial mania has begun to die down. Companies have a firmer grasp on where they stand with economic nexus rules across the states. 

However, managing economic nexus obligations is not a one-time flurry of state registrations. The story doesn’t end there. Your company’s ‘nexus profile’ requires ongoing attention and maintenance to ensure your company stays compliant.

States continue to enact new remote seller legislation – particularly marketplace facilitator laws – and fine tune previously passed legislation. There are numerous key items to monitor to determine if you meet a state’s economic nexus threshold, or potentially just as important, if you no longer meet the threshold.

Not keeping up with how changes in state rules or even changes in your own business impact your nexus obligations opens you up to a lot more risk should an audit come down. 

In this webinar, we will address the practical questions that come up in real business scenarios with economic nexus and registration so you can confidently track changes and stay compliant.

The U.S. Supreme Court’s decision in South Dakota v. Wayfair was a game changer for essentially any business making sales. Following the decision, waves of companies had to comply with new economic nexus rules and register to collect and remit tax in new states. 

Sellers must develop a “Wayfair Strategy” that extends beyond the time you register and get set up with a state. The strategy needs to account for the continual enactment of new remote seller legislation across the states, tweaks to existing state nexus rules, and any changes within the business in that affect nexus.

This ongoing maintenance is a tall order and prompts a lot of questions the states don’t always clearly answer. For example, if you drop below the economic nexus threshold in a state, can you or should you de-register? What happens if you’re a 100% marketplace seller and marketplace facilitator laws are enacted in a state where you’re already collecting? What if you’re above the threshold but all of your sales are exempt, do you need to register? And on and on…
