Sales tax and use tax are complementary. If you make a purchase of taxable property and the seller doesn’t collect sales tax on the transaction, you are required to pay consumer’s use tax.
The challenge is determining the correct amount of consumer’s use tax to pay. It’s important to do it and to make sure that you’re doing it correctly. Since many companies aren’t aware that they have a use tax obligation, states are frequently on the lookout for use tax audits.
On the other side of the coin, since the Wayfair decision was handed down, many businesses are reacting by starting to collect sales tax, and this can have a major impact on purchasers. Post-Wayfair, will all your suppliers begin collecting tax? If so, can you trust that they are doing it correctly? If someone in your company isn’t monitoring this, your costs could increase and there is a very good chance that you may be overpaying sales and use tax.
