Nebraska has enacted legislation that creates a sales and use tax exemption for diapers, effective July 1, 2027. For purposes of the exemption, diapers means absorbent garments worn by humans who are incapable of or have difficulty controlling their bladder or bowel movements. The phrase “worn by humans” is worth noting in that it doesn’t limit the exemption to children’s diapers but extends it to adult diapers as well.
Nebraska is the latest in an increasing number of states who are enacting sales and use tax exemptions for basic human necessities such as diapers and feminine hygiene products. Other states that have enacted similar legislation in recent years include Texas, Maryland, and Louisiana.
