Right now is a crucial time for online marketplace sellers.
More and more states are enacting sales tax nexus legislation that targets online sellers. At the same time, some of these pieces of legislation are being challenged in the courts as being unconstitutional.
There’s a lot at stake.

One state – South Dakota – has petitioned the U.S. Supreme Court to take up its case in an effort to overturn Quill Corp. v. North Dakota, a foundational nexus court ruling.
Almost 900 online sellers participated in the Online Seller Amnesty program last fall to minimize their liability. We also know that a few states have the list of all the FBA Sellers and are systematically sending notices alerting companies that they have past liabilities and must register to collect tax.
It’s an exciting time to watch this unfold, but all this activity means that there is also a lot of uncertainty. How are things going to pan out regarding nexus and tax collection requirements for online sellers? Will Quill be overturned? Will states continue to enact remote seller nexus legislation? Will proposed federal legislation pass? There is a lot to consider.
It has never been more important for online sellers to stay on top of these developments.
If you’re an online seller and you haven’t been aware of your requirements to collect sales tax and you haven’t been making adjustments to recent changes, you could likely be mishandling sales and use tax on your sales. This leads to trouble if you’re audited, potentially resulting in tremendous unexpected costs. In fact, states are cracking down hard on online sellers and starting to limit the opportunity for tax amnesty.
