Right now is a crucial time for online marketplace sellers.

More and more states are enacting sales tax nexus legislation that targets online sellers. At the same time, some of these pieces of legislation are being challenged in the courts as being unconstitutional.

There’s a lot at stake.

One state – South Dakota – has petitioned the U.S. Supreme Court to take up its case in an effort to overturn Quill Corp. v. North Dakota, a foundational nexus court ruling.

Almost 900 online sellers participated in the Online Seller Amnesty program last fall to minimize their liability. We also know that a few states have the list of all the FBA Sellers and are systematically sending notices alerting companies that they have past liabilities and must register to collect tax.
